Bill to Legalize Recreational Cannabis Dies in PA Senate Committee
On Monday, May 5, Democrats on a Pennsylvania state House committee approved a bill, HB1200, to legalize recreational cannabis in the Commonwealth. As of this writing, this does not mean that recreational cannabis is legal in Pennsylvania. The bill ultimately died at the committee level. However, it does represent a step in that direction.

HB1200 Cannabis Bill Doesn’t Pass Through PA Senate Committee
The following points clarify the nature and status of the bill that recently received a House committee’s approval among Pennsylvania Democrats:
- The current version of the bill is 173 pages long. It was originally circulated the night of Sunday, May 4, with committee action on the bill set for the Monday after. According to at least one report, this sequence of events is relatively unusual compared to how such bills are normally circulated or introduced.
- After receiving approval at the House committee level, HB1200 ultimately died in the Pennsylvania Senate Law and Justice Committee in a 3-7 vote.
- According to Republicans who voted against the bill, one of their main objections is that it would have permitted the Pennsylvania Liquor Control Board to sell cannabis at its state-run stores. Per State Rep. Dan Laughlin (R-49th dist.), who is among those who voted the bill down, “a state-store model for adult-use cannabis will not pass the Senate. That’s not an opinion, it’s a fact.” Laughlin argues that Democrats understand this point and thus introduced the bill without it being a serious attempt at legalizing recreational cannabis in the state. According to Laughlin, circulating this bill was merely an attempt to shift the blame for inaction back onto Republicans.
- Legislators have estimated that the sale of legal recreational cannabis could generate more than half a billion dollars in taxes and profits annually for the Commonwealth. Combined with the fact that most of Pennsylvania’s neighboring states have already legalized recreational cannabis, this is one of several reasons it’s unlikely the issue is going to be abandoned.
