When emotions are high during a confrontation, it is easy to say things we later regret – and this is especially true when the conflict is between spouses or significant others. However, while we all need to apologize once in a while for flying off the handle during an argument and saying things we don't mean, sometimes the things we shout in anger can have a permanent negative effect on our lives. This is particularly true when one person threatens another and law enforcement becomes involved.
Recently Mark Gwozdz, a police officer in Pennsylvania, threatened his wife during an argument, and the consequences to his career and life have been nothing short of devastating. As a result of his actions, Gwozdz will never again work as a police officer, and he has also been permanently banned from his part-time job as a school bus driver. While the rights of the individuals on the receiving ends of threats certainly need to be protected, the rights of the accused are equally important, and strong legal representation can help them achieve more favorable outcomes.
A Life Forever Damaged
When 48-year-old Gwozdz was accused of threatening his wife in 2019, he was a police officer with the Washington Township Police Department. He had a long and stable career in law enforcement, with no violence or domestic abuse history. These factors all played a role in Gwozdz's sentencing and probably impacted the judge's decision to avoid sending him to jail – however, he did receive 12 months of probation after being convicted of making terrorist threats. Gwozdz was also required to undergo anger management, pay a fine, and avoid his soon-to-be ex-wife.
It is worth noting that the allegations against Gwozdz were severe – his wife reported that her husband had threatened her life. At this point, she called the police and filed for a protection from abuse (PFA) order. Gwozdz's wife also claimed that Gwozdz, who had been married four times, had made other “concerning statements” during their relationship that she had not reported to the police. Because Gwozdz was a police officer, many stakeholders believe he should have known better and been more conscious of the potential consequences of his actions on his career.
But none of this changes the fact that Gwozdz – and all individuals accused of domestic violence – also have rights, and they deserve strong representation in court.
