PA Business Pleads Guilty to Tax Evasion and Harboring Illegal Aliens

Posted by Joseph D. Lento | May 09, 2025 | 0 Comments

A recent case involving the former owner of a temporary staffing agency in Pennsylvania highlights the way white-collar crimes can often overlap, resulting in multiple charges.

For 1.5 years, Andy Ha of Belle Vernon, PA, owned Prosperity Services, Inc. During this time, while operating in his capacity as owner of the business, Ha paid for the lodging of more than 25 workers not legally permitted to work in the U.S. His business also paid for transportation services for these workers to help them travel to job sites.

Additionally, the spreadsheets Ha provided to the business' tax return preparer only listed the employees with legal permission to work in the country. Ha has now pleaded guilty in federal court, admitting he harbored illegal aliens for financial gain and broke tax laws by failing to pay employment taxes.

The Case Background

The basic facts of the case are as follows:

Again, Ha has already pleaded guilty to charges relating to tax evasion and harboring illegal aliens. As of this writing, sentencing is set for later this year.

It's impossible to know at this time the specific sentence the judge will hand down. The total maximum sentence the law allows for in regard to the tax evasion charge consists of:

  • Up to five years in prison
  • A fine of up to $250,000 or twice the amount gained from the offense
  • Both

The maximum penalties the law allows for in regard to the harboring illegal aliens charge consist of the following:

  • Up to 10 years in prison
  • A fine of up to $250,000 or twice the amount gained from the offense
  • Both

Although Ha will undoubtedly face penalties, if he enlisted the help of a qualified lawyer, he may have been able to present mitigating factors (such as a lack of a prior criminal record) to justify a light sentence.
