Pennsylvania’s Attorney General recently announced that charges had been filed against 14 defendants for allegedly distributing fentanyl, cocaine, and crack cocaine across Beaver, Allegheny, and Washington counties. The List of Drug-Related Charges
The defendants are accused of being part of a group that distributed and sold fentanyl pills, cocaine, and crack cocaine across the three western Pennsylvania counties. Charges against the defendants include the following, with not every defendant charged with every one of these crimes:
- Dealing in proceeds of unlawful activities, a first-degree felony that can be charged when a defendant allegedly makes a financial transaction involving illegally obtained property
- Illegal possession of a firearm based on a previous conviction is a second-degree felony
- Criminal use of a communications facility, a third-degree felony that can be charged when the defendant is accused of using a phone or other communications tool to help commit any felony
- Criminal conspiracy, a charge that is based on allegations that two or more defendants agreed with each other to commit a crime; in this case, a felony charge that two or more defendants agreed to possess or deliver illegal drugs
- Corrupt organizations charge, including a related conspiracy charge, based on groups of defendants allegedly working together as an organized group to commit and profit from certain crimes through a “pattern of racketeering activity,” both of which are first-degree felonies
- Illegal possession of controlled substances, a misdemeanor, and multiple counts of delivering controlled substances or possession of controlled substances with intent to deliver, each a felony
Note that when prosecutors go after alleged drug dealers, they will typically pile on as many charges as possible. This increases the pressure on every defendant. In this case, for example, each first-degree felony charge carries a potential sentence of up to 20 years and a fine of up to $25,000. A third-degree felony conviction can result in a 7 year prison sentence and up to $15,000 in fines.
