Real Arrest for Reality TV Star

A reality TV star is facing potential criminal charges after a December 2024 arrest for possible misdemeanor domestic violence. Police had arrived at a residence to find the star arguing with a woman.

James Kennedy, who has been on ten seasons of “Vanderpump Rules,” vowed to seek help following the arrest. His statement, posted on Instagram, said the reality TV star would be making changes to his life, including pursuing sobriety.

Charges Pending

Police arrived at a residence in Burbank, CA, in December 2024 to find Kennedy arguing with an unidentified woman. The woman claimed he picked her up and threw her to the ground during the dispute.

Police arrested Kennedy, who was later released on bail. The Burbank city attorney hasn't responded to media requests about possible charges against the reality TV star.

Charges aren't automatic in domestic violence cases. Law enforcement and attorneys often have to investigate the situation, including interviewing involved parties or witnesses.

In some cases, a court may issue a restraining order, known as a stay-away order in Pennsylvania. In Pennsylvania, stay-away orders are automatically issued at the start of a domestic violence case. One reason these are automatic is to protect victims while authorities investigate the validity of the claim.

If a victim wishes to file for a Protection from Abuse order (PFA), they will file in civil court. An individual may have a PFA against them even if they aren't facing criminal charges.

While protecting victims is vital in investigations, these efforts to protect victims can also hurt the accused. The effects of a stay-away order or PFA can extend long past the initial incident, even if circumstances are found to indicate domestic violence didn't occur.

No Minor Domestic Violence Crimes

While a misdemeanor conviction is less serious than a felony conviction, it can still carry long-term repercussions. Fines, probation, and potential jail time are all possibilities.

Even without being charged or convicted, an accusation of domestic violence can affect a person's life. Having a stay-away order or PFA against them can limit their lives in numerous ways. It may hurt them professionally or personally.

As seen in the case of Kennedy, news articles may report the possibility of domestic violence even without a criminal charge. This means that an individual's reputation may be negatively impacted even if they aren't charged.

Being accused of domestic violence isn't minor. That's why it's important to be proactive in defending against accusations. Investigations aren't necessarily comprehensive, and individuals may need to provide evidence or other information.
