The Second Amendment, which protects the right to keep and bear arms, means that anyone can own firearms and use them for self-defense in the event of an attack. However, if that right is abused by any person, such as in the case of possession by a dangerous person or straw purchases of firearms, that constitutes a violation and can lead to arrests.
This is exactly why, last month, 29-year-old Tahir Zahir of Sharon Hill in Delaware County, PA was arrested for the straw purchases of firearms between 2018 and 2023. Weapons or Firearms Charge in Pennsylvania?
The Uniform Firearms Act under the Pennsylvania Consolidated Statutes covers a broad range of offenses that can lead to a firearms or weapons charge. Some of these include:
- Unlawful possession of modified guns, explosives, machine guns, and other weapons capable of inflicting injury.
- Prohibited firearm possession of certain persons, including ex-cons, mentally unstable or incompetent people, people convicted of DUI offenses, and others.
- Illegal sale or transfer of firearm to persons prohibited from owning/carrying a firearm or those who haven't applied to buy or own a firearm.
As you may have observed, a significant part of the legislation is dedicated to people who have previously committed crimes and are not allowed to legally own firearms anymore. People who have been convicted of the following crimes cannot own or carry firearms in this Commonwealth:
- Aggravated assault
- Stalking
- Sex crimes
- Breaking and entering or robbery
- Arson
- Murder
- Voluntary or involuntary manslaughter
Consequences of a Guilty Charge for Illegal or Prohibited Firearms Activities
Possession of a prohibited weapon, illegal sale of weapons, false declarations on firearms purchase forms, or other crimes may be charged as a misdemeanor or felony, depending on the circumstances and whether the person is a repeat offender.
In Mr. Zahir's case, he was charged with multiple counts of criminal conspiracy, illicit sales of guns, dealing in proceeds of unlawful activities, making false statements on firearms purchase forms, selling to an ineligible transferee, and providing false reports and statements under penalty.
After his arraignment, he was taken to a Bucks County Correctional Facility with a bail set at $1 million. If found guilty, the defendant can face anywhere from 1 to 10 years imprisonment and may be required to pay a fine of up to $25,000 per offense.
