Trevor Bauer’s Restraining Order Battle

Restraining orders and Protection from Abuse orders (PFAs) are difficult, often emotionally jarring cases for all parties involved. Although these orders serve their purpose by helping protect victims of domestic violence, they also impose severe restrictions on accused parties. When a restraining order battle goes public or involves a publicly known figure, it becomes more complicated.

An Ongoing Restraining Order Battle

MLB pitcher Trevor Bauer has been embroiled in a restraining order case for the last few months since a woman filed a petition for a restraining order against him in June. Restraining orders in California are similar to PFAs in Pennsylvania in that the court files a temporary order, and both parties attend a hearing to determine if a permanent order replaces it.

In August, at a hearing, Judge Dianna Gould-Saltman of Los Angeles Superior Court ruled that Bauer did not pose a future threat to the 27-year-old woman who accused Bauer of sexual assault. Gould-Saltman did not order a permanent restraining order and dissolved the temporary order that Bauer had against him.

Although the judge dropped the restraining order, the Dodgers pitcher could still face consequences from the MLB. Since the case started he's been on administrative leave, and his leave was renewed for a fifth time in August. The MLB is still investigating, deciding whether or not to suspend him under the league's domestic violence policy. Bauer is still under investigation by the Pasadena Police Department for possible criminal charges as well.

When PFA Disputes Go Public

PFA battles involving public figures don't unfold the same way as they do for other individuals. Because Trevor Bauer is one of the most well-known pitchers in the MLB, he has to be more cautious about where he goes and what he says so as not to violate the restraining order or appear that he's violating it.

Both parties in a PFA battle are under more scrutiny when it's public. In Bauer's case, the petitioner gave statements to the press about her encounters with him, which can ultimately impact how the judge views the case.

There are implications of PFAs that impact everyone, however, no matter how famous they are. Bauer's restraining order has prevented him from doing his job, pitching for the Dodgers. A PFA can also prevent someone from doing their job if they share a working space with their petitioner, if they have professional equipment at their home but must vacate their home immediately following a PFA, or if their job requires them to carry a firearm.
