What Is a PFA Order in Pennsylvania?
Protection from Abuse (PFA) orders are restraining orders designed to protect victims of domestic abuse. A plaintiff seeking a PFA can file a written petition with the court, in which case the defendant will be notified of the proceedings.
In many cases, if the alleged victim claims they are in immediate danger, a judge will issue a temporary or emergency PFA order before any formal hearing occurs.
When under a PFA order, whether temporary, emergency, or final, the defendant will be subject to strict requirements, including avoiding all contact with the plaintiff and refraining from entering their home or workplace.
Can a Coworker File a PFA Order Against You?
A plaintiff can only file a PFA order against a partner or a family member. This includes a spouse, a blood relative, a household member, an individual with whom they share a biological child, or a current or former sexual partner.
A coworker can only file a PFA order against you if you are in one of these qualifying domestic relationships. If this is the case, a plaintiff can file a PFA order against you even if you share the same workplace.
Can a Coworker File Any Other Legal Orders Against You?
If your coworker is unable to file a PFA against you, they may still be able to file a Sexual Violence Protection Order (SVPO). An SVPO is a type of restraining order meant to protect victims of sexual assault, whether or not the plaintiff and defendant are engaged in a domestic relationship. Like PFA orders, SVPOs prohibit defendants from having any contact with the plaintiff.
Can Legal Orders Filed Against You Affect Your Employment?
Expectedly, if a coworker files an SVPO against you or your partner files a PFA order against you, and you share a workplace, this can adversely affect your employment. Additionally, when a plaintiff successfully acquires a PFA order against you, your name will be placed in a national database.
