Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle after consuming alcohol in a quantity that impairs safe operation.
Being Generally Impaired
Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle after consuming alcohol in a quantity resulting in a concentration of between .08% and .10%. This BAC measurement must be obtained within two-hours after vehicle operation.
High Level of Alcohol
Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle after consuming alcohol in a quantity resulting in a concentration of between .10% and .16%. This BAC measurement must be obtained within two-hours after vehicle operation.
Highest Level of Alcohol
Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle after consuming alcohol in a quantity resulting in a concentration exceeding .16%. This BAC measurement must be obtained within two-hours after vehicle operation.
Minor Operating Under the Influence of Alcohol
Minors are deemed as being over the BAC threshold at .02%
Under the Influence of a Controlled Substance
Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle when their blood contains:
- A Schedule I controlled substance
- A Schedule II or III controlled substance that is not prescribed by a physician
- Metabolites of scheduled controlled substances
- Multiple drugs that impair safe vehicle operation
- A combination of alcohol and a drug that impairs safe vehicle operation
- Under the influence of “solvent or noxious” substances (examples include benzene, methyl alcohol, nitrous oxide)
Bucks County Accelerated Rehabilitative Disposition (ARD)
The Bucks County District Attorney implemented the ARD program. This is an interventional process geared toward first-time offenders with non-violent offenses such as DUI and drug possession. Offenders may avoid any required minimum jail sentences. Those in the program who are subsequently arrested or otherwise violate the rules will face their original charges.
