Driving Under the Influence of Alcohol § 3802: Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle after consuming alcohol in a quantity that impairs safe operation.
Blood Alcohol Levels (BAC)
- General Impairment: .08% - .10%
- High Level: 10% - .16%
- Highest Level: Greater than .16%
- For Minors: .02%

Ignition Interlock Device Requirements
Pennsylvania now requires that first-time offenders who have a blood alcohol concentration of .10% have an ignition interlock device installed on their vehicle.
Driving Under the Influence of a Controlled Substance § 3802: Individuals are prohibited from driving, operating, or otherwise controlling the motion of a vehicle when their blood contains:
- A Schedule I controlled substance or Schedule II or III controlled substance that is not prescribed by a physician
- Metabolites of scheduled controlled substances
- Multiple drugs that impair safe vehicle operation or a combination of alcohol and a drug that impairs safe vehicle operation
- Under the influence of “solvent or noxious” substances
How Many Years Back Can the Court Look for Prior DUI Offenses?
You may be charged as a repeat DUI offender based on any convictions in the prior 10 years. In 2016, over 10,000 people in Pennsylvania were convicted of a second or subsequent DUI. Much of the most recent legislation has since focused on imposing mandatory minimum penalties on repeat offenders.
New Enhanced DUI Penalties in Pennsylvania
Act 153 has been implemented that allows for felony charges for third-time DUI offenders and all those with a fourth offense. Those found to be driving while under a DUI-related license suspension now face a jail sentence of between 60 to 90 days. Those convicted of homicide by vehicle with a prior offense face a minimum of five years in prison.
