Is There Such a Thing as 'Accidental Rape'?

Posted by Joseph D. Lento | Mar 08, 2024 | 0 Comments

The Me Too era has shown the world that two people can sometimes experience an encounter very differently. From high-profile celebrities and political figures to regular people in communities everywhere, interactions have been altered in every place where people live, work, and gather.

Not an "Intentional Rape"

Justin Hain, an officer for the Steelton Borough Police Department in Pennsylvania, was recently charged with rape after a woman he knows well said that he forced himself on her. Hain, however, has said that he did not "intentionally rape" the woman and that he feels deeply sorry about the incident.

According to the woman, she had just stepped out of the shower when Hain approached her with a "weird grin" on his face. She said she told him not to touch her but that he pulled her towel off and pinned her to a couch, then sexually assaulted her, though she repeatedly told him no.

After Hain left for work, she called the police and reported the attack. Hain is now facing four felony charges of forcible compulsion, rape by forcible compulsion, and two counts of sexual assault as well as two misdemeanor charges of indecent assault.

The Post-Me Too Era

For the past few years, in case after case, victims have reported sexual assaults and rapes after sexual experiences that their alleged perpetrators believed to be consensual.

It's easy to define a rape or sexual assault when it happens violently, the result of an attack by a stranger. But what if the attacker is someone who has permission to be in the home? What if that person is a friend, lover, or roommate? What if it's not clear to both people that consent has not been given?

If you have been accused of sexually assaulting or raping someone in an encounter you believed was consensual or in a place where you reside or had permission to be, the LLF Law Firm Criminal Defense Team can help. Call us today or contact us online to discuss your situation.

Hain has been dismissed from the police department because of the incident. His bail was set at $50,000, and he is prohibited from contacting the woman while on bail.
