Pennsylvania's own Perkiomen Valley School District has received a series of threats following the release of its schools' bathroom policy permitting transgender students to utilize the bathroom of their sexual identity. The threats included an email threatening violence and continued harassment stating, "We're not going to tolerate you sick perverted freaks, you are child abusers and have forfeit your right to life you (expletive) pieces of (expletive). We will (expletive) kill all of you bastards" and "You will undo this bathroom decision[,] or you will continue to face our wrath."
The email also included a bomb threat stating, "We placed bombs at Perkiomen Valley High School, district buildings, and a target." Perkiomen Valley School District felt the threats were serious enough to call for an early dismissal. Have You Been Accused of Threatening to Commit a Violent Crime?
If you are behind a death threat or bomb threat or have threatened to commit other violent crimes, you are likely facing serious legal action against you. The charges you are probably facing are what Pennsylvania law calls terroristic threats. The LLF Law Firm's Criminal Defense Team can help you fight these charges.
When you think of a terroristic threat, you might think that it is limited to things like bomb threats, threats of mass shootings, or threats of arson, but the law is much broader. Pennsylvania law states that it is a crime to communicate, either directly or indirectly, a threat to:
- Commit any crime of violence with the intent to terrorize another;
- Cause evacuation of a building, place of assembly or facility of public transportation; or
- Otherwise cause serious public inconvenience or cause terror with reckless disregard for the risk of causes such terror or inconvenience.
How Serious Are These Charges?
The consequences of terroristic threat charges can be severe, ranging from paying large amounts of money in restitution to jail time. Depending on how the threat played out, you will either be facing a first-degree misdemeanor charge or a third-degree felony charge. In Pennsylvania, first-degree misdemeanor convictions can result in a prison sentence of two and a half to five years and a fine of up to $10,000. A third-degree felony conviction in the state can get you between three and a half and seven years of prison time and a fine of up to $15,000.
If your threat has caused an evacuation, the court may also order you to pay for the costs involved in the evacuation and response to your threat. These costs could include services provided by SWAT teams, firefighters, police, and other emergency personnel.
